Terms of Service
1. Who we are
Provenance is operated by Berrada Ventures LLC, a single-member limited liability company organised in the State of New York ("Provenance", "we", "us").
- Contact: Support@useprovenanceapp.com
- Notice address: 1548 Waterford Rd., Walworth, NY 14568
By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.
2. What Provenance does — and what it does not
Provenance lets you upload files documenting how you created your work. When we receive a file we record the time we received it and compute a SHA-256 cryptographic hash of its contents. You can later export an Originality Packet: a PDF listing those files, the time each was received, and its hash.
What that establishes. A timestamped, tamper-evident record that a specific file, with a specific hash, was received by us from your account at or before a specific time, and has not changed since.
What it does not establish. Provenance does not prove, and does not claim to prove:
- that you legally own a design;
- that you were the original creator of anything;
- that you conceived of something before anyone else;
- when a file was originally created, as distinct from when we received it;
- that any marketplace, platform, court or other body will accept, credit, or act on the record.
Dates reported by your files. Where the service displays a creation or capture date read from a file's own metadata, that date is reported by the file and the device that made it. We do not verify it and we cannot verify it. Such metadata can be edited by anyone with ordinary software. What we can show is that the metadata has not changed since we received the file, because it forms part of the hashed contents.
No affiliation. Provenance is not affiliated with, endorsed by, or connected to Etsy, Inc. or any other marketplace. References to any marketplace's policies are for information only. Those policies are set by them, change without notice, and are not ours to interpret on your behalf.
No guaranteed outcome. Nothing in the service is a promise that an appeal will succeed, a listing will be reinstated, an account will be preserved, or a dispute will be resolved in your favour.
Not legal advice. Nothing we publish or generate is legal advice. If your rights are at stake, consult a lawyer.
3. Your account
You must be at least 18 years old and able to enter a contract. You are responsible for keeping your login credentials secure and for everything done through your account. Tell us promptly at Support@useprovenanceapp.com if you believe your account has been accessed without your permission.
One account per person or business entity. Do not share credentials.
4. Plans, limits and how they work
4.1 The plans
| Free | Pro Monthly | Pro Yearly | |
|---|---|---|---|
| Price | $0 | $12 per month | $99 per year |
| Products | 5, lifetime | Unlimited | Unlimited |
| Evidence files | 25, lifetime | Unlimited | Unlimited |
| Storage | 5 GB | 50 GB | 50 GB |
| Additional storage | Not available | $10 per month per 50 GB | $10 per month per 50 GB |
| Features | All | All | All |
Free and Pro accounts have identical functionality. Pro removes capacity limits. There is no feature held back from the Free plan, and there is no free trial of Pro — the Free plan is permanent.
Pro Monthly and Pro Yearly are the same plan billed over different periods.
4.2 How the Free limits are counted — read this part
The Free plan's product and evidence-file limits are lifetime totals, not concurrent totals.
- A product slot is consumed the first time you upload a file to a product. Creating and renaming a product costs nothing.
- Deleting a product or a file does not return the slot or the file count. Once you have created 5 products and uploaded 25 evidence files on a Free account, you have used your Free allowance permanently, whether or not those items still exist.
- Storage is measured differently. It reflects what you are currently storing, so deleting a file does free up space.
You can always delete your own data — see section 8. What does not come back is the allowance.
4.3 Behaviour at the limits
On Free: when you reach a limit, further uploads are declined and you will be prompted to upgrade. Existing data is unaffected.
On Pro: we will warn you as you approach your storage limit and will not block uploads. We would rather store more than you paid for than refuse to record something at the moment it matters to you. Persistent and substantial overage may lead us to contact you about additional storage.
Fair use. The service is for recording your own creative process. It is not general-purpose file storage or a backup service, and we may act on accounts that use it as one.
5. Payment, renewal and cancellation
Payments are processed by Stripe. We do not receive or store your full card details.
Subscriptions renew automatically — monthly for Pro Monthly, annually for Pro Yearly — at the then-current price, until cancelled. We will give at least 30 days' notice by email before any price increase applies to your renewal.
You may cancel at any time. Cancellation takes effect at the end of your current paid period; you keep Pro access until then. After that date your account is closed and your data is deleted. Section 6 sets out exactly how, how much notice you get, and how to stop it. Please read it before you subscribe.
Availability by location. We currently sell subscriptions throughout the United States. If our tax registrations ever require us to stop selling in a particular state, the Free plan remains fully available there and we will say so at checkout.
Refunds are governed by our Refund Policy, which forms part of these Terms. A refund also ends your subscription. From that point the cancellation path in section 6.1 applies: your account becomes read-only, we email you, and you have 24 hours to take your data out before it is deleted.
Taxes. Prices exclude applicable sales tax, which is added at checkout where required.
6. What happens if your subscription ends
This is the most important section in these Terms. Read it before you subscribe.
Provenance is a subscription service, not a permanent archive. When your Pro subscription ends, your account is closed and your files are permanently deleted. We give you a window to take everything with you first, and we email you before it happens.
6.1 If you cancel
Your cancellation takes effect at the end of the period you have already paid for. Until that date nothing changes — you keep full Pro access.
On that date your account becomes read-only and we email you to tell you that you have 24 hours left. When those 24 hours are up, your files, your products, the removal records attached to them and your account are permanently deleted.
6.2 If your payment fails
If we cannot collect payment and your subscription ends as a result, your account becomes read-only and we email you to tell you that you have 7 days. We email you a second time 24 hours before the deadline.
If the 7 days pass without a successful payment, everything above is permanently deleted.
6.3 What you can do during the read-only window
In both cases, until the deadline you can still:
- view all of your existing evidence;
- download any individual file;
- download your entire account in one archive, including every original file and a manifest listing each file's name, SHA-256 hash, received date and capture date;
- generate and export Originality Packets.
You cannot add new evidence during that window.
6.4 Changing your mind
Reinstating your subscription at any point before the deadline cancels the deletion completely. Nothing is lost, and you do not need to contact us — the scheduled closure and the remaining warning emails are cancelled automatically.
Once the deadline passes there is nothing to reinstate. If you sign up again afterwards, even with the same email address, it is a new and empty account. We cannot restore a closed account, and we do not keep a copy.
6.5 Free accounts
None of this applies to Free accounts. A Free account stays open and its data stays where it is. Section 6 is about subscriptions ending, not about accounts being inactive.
7. Your content
You own your files. Uploading them to Provenance transfers no ownership to us.
You grant us a limited, non-exclusive licence to store, process, transmit, hash, and display your files back to you strictly to operate the service. We do not use your content to train models, we do not sell it, and we do not disclose it to anyone except as described in the Privacy Policy or where legally required.
You are responsible for what you upload. You confirm you have the right to upload each file and that doing so does not violate anyone's rights or any law. Do not upload unlawful content, malware, or another person's private information without their permission.
We do not review your content for accuracy, originality, or anything else. We record what you send us. We do not verify that it depicts what you say it depicts.
8. Deleting things
You can delete your own data at any time. Individual files, whole products, or your entire account.
What deletion does:
- The file itself is removed from active storage promptly.
- A record that the file existed and was deleted is kept as part of that product's history. It holds the file's name, its SHA-256 hash, its size, the time we received it, and the time you deleted it. Nothing else — not your description, not the evidence category, not the capture date or any other information read from inside the file.
- That record appears in your evidence log and in any Originality Packet you generate afterwards. An evidence record that can be silently rewritten is not evidence, which is the entire point of the product, so removals are recorded rather than erased.
- We cannot recover the file. The record proves it existed. It is not a backup.
- What this does and does not mean. It means the evidence attached to a product cannot be swapped out without leaving a trace. It does not mean your record is unchangeable — deleting an entire product deletes its removal history along with it. We say "removals are recorded", and we do not claim more than that.
- If the filename itself is private — you deleted a photo because of who or what was in it, and the name gives that away — email us and we will remove the name from the record. The hash and the two dates stay, so the record still shows a file existed and was removed.
- On the Free plan, deletion does not restore your allowance (section 4.2).
- Deleted data may persist in our routine backups for up to 7 days before those backups age out.
Deleting your account removes your files, your products, and every removal record attached to them, and cancels any subscription. Deletion is complete: we do not keep removal records for accounts that no longer exist. Some records are retained where the law requires it, such as billing and tax records. See the Privacy Policy for detail.
9. Availability
We try to keep the service running and available. We do not promise uninterrupted or error-free operation, and we may modify or discontinue features. If we discontinue the service entirely, we will give you reasonable notice and a way to export your data before it goes.
10. Our liability
To the maximum extent permitted by law:
- The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, or lost goodwill.
- We are specifically not liable for the outcome of any marketplace decision, appeal, dispute, takedown, suspension, or legal proceeding, whether or not you used a record produced by this service.
- Our total aggregate liability for any claim relating to the service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) fifty US dollars ($50).
Some jurisdictions do not allow some of these exclusions, in which case they apply to you only to the extent permitted.
11. Indemnity
You agree to indemnify and hold harmless Berrada Ventures LLC and its member from claims, damages, losses, and reasonable legal fees arising from your content, your use of the service, or your breach of these Terms.
12. Suspension and termination
We may suspend or terminate an account that breaches these Terms, that is used unlawfully, or that creates risk or material burden for us or other users. Where circumstances allow, we will give notice and an opportunity to export data first.
13. Changes to these Terms
We may update these Terms. Material changes will be notified by email or in-product at least 30 days before they take effect. Continuing to use the service after that means you accept the updated Terms. The "Last updated" date at the top always reflects the current version.
14. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict of laws rules. Any dispute will be brought exclusively in the state or federal courts located in Wayne County, New York, and you consent to that jurisdiction and venue.
15. General
These Terms, with the Privacy Policy and Refund Policy, are the entire agreement between us. If a provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
